Gestión de riesgos en la administración y recaudación del impuesto predial para fortalecer la gestión municipal

This document offers guidance to municipal governments in Peru on managing risks that affect the efficient administration and collection of property taxes. Property taxes are a major source of revenue for municipal governments in Peru, yet collection rates appear low compared to other countries in Latin America.
The guidance is a product of the Basel Institute’s Subnational Public Finance Management Strengthening Programme (Programa GFP), supported by the Swiss SECO Cooperation in Peru since 2015.
It is the first in a series of documents on risk management to improve the delivery of public services and goods at the subnational level. Using the guidance, officials will be better able to develop relevant control measures for their annual action plan on internal controls.
Effective implementation of these measures will enable municipalities to achieve their institutional objectives more efficiently, thus better serving the people of Peru.
The guidance document, published in Spanish, is based on the provisions of a Peruvian Government directive and guidelines on risk management and internal controls for state entities. It also draws on the experiences of our Public Finance Management team providing technical assistance to officials in the Peruvian municipalities of Abancay, Cusco, Piura, Tarapoto and Trujillo.

Este documento de trabajo ofrece orientación a los gobiernos municipales de Perú sobre la gestión de los riesgos que afectan a la administración y recaudación eficaces de los impuestos prediales. El impuesto predial es el principal impuesto a nivel municipal en el país. No obstante, la recaudación predial en el Perú representa solo el 0,25% del Producto Bruto Interno (MEF, 2022). Esto es bajo comparado con otros países en América Latina.
Es el primero documento de la serie “Gestión de Riesgos para mejorar la entrega de productos a nivel subnacional”, la cual consiste en documentos de trabajo vinculados a las materias focalizadas. Estos documentos recogen la experiencia de los gobiernos regionales y gobiernos locales socios del Programa GFP Subnacional y el conocimiento de sus consultores, a fin de convertirse en un insumo práctico para identificar y tratar los principales riesgos que pueden afectar la producción y la entrega de bienes o servicios y el logro de los objetivos institucionales de las entidades a nivel subnacional.
Esta serie se desarrolla sobre la base de las disposiciones de la Contraloría General de la República del Perú (CGR) en la Directiva N° 006-2019-CG/INTEG, “Implementación del Sistema de Control Interno en las Entidades del Estado” (en adelante, Directiva SCI) y las orientaciones en la “Guía para la Gestión de Riesgos para los Gobiernos Regionales, en el marco de la implementación del Sistema de Control Interno” (CGR, 2022b). Asimismo, adopta las pautas de la Secretaría de Integridad Pública de la Presidencia del Consejo de Ministros, en la “Guía de Gestión de Riesgos que afectan la Integridad Pública” (PCM, 2023).
En este sentido, las propuestas contenidas en estos documentos de trabajo pueden ser consideradas por las entidades cuando elaboren su “plan de acción anual - sección medidas de control”, que es una herramienta establecida por la CGR, en el marco de la implementación del SCI.
El desarrollo y la elaboración de este documento han sido posible gracias al Programa de Fortalecimiento de la Gestión de las Finanzas Públicas a Nivel Subnacional en el Perú (2019-2023) - Programa GFP Subnacional, de la Cooperación Suiza - SECO, implementado por el Basel Institute on Governance - Perú.

Desafíos para la ejecución de grandes proyectos de inversión desde los gobiernos subnacionales del Perú

This analysis reveals the challenges that local and regional governments in Peru face in implementing public investment projects such as energy, transport and telecommunications infrastructure.
Its case studies and recommendations will help all those implementing or monitoring public projects to anticipate problems and better achieve objectives.
The report, published in Spanish, is based on the experiences and research of the Basel Institute’s Subnational Public Finance Management Strengthening Programme (Programa GFP), supported by the Swiss SECO Cooperation in Peru since 2015.

Según diferentes estudios, las demoras en la adjudicación de los proyectos y la paralización de inversiones en ejecución se encuentran entre las principales razones que explican el bajo impacto de la inversión pública en la competitividad. Al respecto, se ha calculado que los países pierden en promedio entre 30% y 50% de los beneficios en el proceso. En el Perú, específicamente, se pierde el 40% debido a las dificultades en la administración de dichos proyectos (FMI, 2020).
Ante dicha problemática, se hace necesario fortalecer las capacidades de los gobiernos subnacionales para la ejecución de la inversión pública y para superar los desafíos que estos procesos plantean.
En tal sentido, el presente documento se plantea como objetivo contribuir con la mejora de las capacidades de los niveles de gobierno regional y local en la ejecución de la inversión pública, a través del estudio de casos referidos a la identificación y análisis de situaciones adversas y obstáculos recurrentes que afectan o pueden afectar la continuidad, el resultado o el logro de los objetivos.
Ello permitiría a los funcionarios de gobiernos subnacionales contar con mayores herramientas para el diseño y gestión de los proyectos a su cargo.
La publicación fue desarrollada en el marco del Programa GFP Subnacional de la Cooperación Suiza-SECO, implementado por el Basel Institute on Governance.
Guía para la gestión de riesgos que afectan la Integridad Pública
This guide to managing risks that affect public integrity was developed by Peru’s Secretariat for Public Integrity of the Presidency of the Council of Ministers, with technical assistance from the Swiss-funded Subnational Public Finance Management Programme implemented by the Basel Institute on Governance.
The guide seeks to help Peru’s public institutions reduce the risk of corruption and other misconduct, especially in critical areas such as service provision, public procurement and human resources.
It provides detailed guidance on the conceptual framework and fundamental aspects of integrity risk management plus the four phases: identification, evaluation, mitigation and monitoring/continuous improvement.
The guide was adopted by the Peruvian Government on 9 January 2023, Resolution N°001-2023-PCM/SIP.
Papering over cracks or building stronger systems together? Financial crime in the context of covid-19
This article is the Basel Institute’s contribution to the Global Forum on Law, Justice and Development Review of Legal Experiences and Global Practices Relating to COVID-19, published in December 2021. The Global Forum is an initiative of The World Bank. The contribution was submitted in July 2020; the version below contains minor updates to hyperlinks.
It explores how covid-19 has exposed cracks and flaws in the systems designed to protect communities from corruption and has accelerated existing trends in financial crime. The next systemic disruption may come from another pandemic, climate change or perhaps biological or cyber attacks. Whatever the future holds, it is clear that financial crime systems must become more resilient if they are to protect us.
The article notes that the world has an opportunity to reflect meaningfully on the problems and build stronger, more efficient and effective systems against financial crime. It covers three areas:
- Technology, and how technology upgrades in law enforcement and criminal justice proceedings are necessary but not sufficient
- Streamlining and speeding up procedures in cases of financial crime, such as mutual legal assistance
- Citizen engagement in the fight against financial crime, including mobilising citizens by using recovered proceeds of corruption and crime to fund essential healthcare services.
