Esto es, bajo la convicción de las ventajas del pensamiento autocrítico, la CCERA apunta a contribuir en la discusión que reconozca a la extinción de dominio como un mecanismo jurídico complejo, pero al mismo tiempo útil y global, como eficiente respuesta político criminal ante la actividad de las más sofisticadas organizaciones criminales.\n\nAsí las cosas, los productos de conocimiento de la CCERA pretenden abordar asuntos puntuales de la figura de la extinción de dominio, siendo esta la tipología dominante de recuperación de activos ilícitos sin condena en América Latina. Por ende, a partir del amplio conocimiento sobre la materia de los miembros de la CCERA, se busca aclarar los conceptos de la extinción de dominio que suscitan o han suscitado controversia en su aplicación.\n\nEn concreto, en este producto se establecen las líneas esenciales de la problemática de la retrospectividad de la ley de extinción de dominio. En este sentido, se abordan, principalmente, la posición dominante en la materia; algunas posiciones contrarias o disidentes; y, finalmente, una perspectiva crítica que introduce al debate un nuevo ángulo de discusión referido a la extinción de dominio como una acción civil con contenido criminal, cuya legitimidad está acotada por el respeto a los derechos fundamentales. \n\n### English\n\nThe paper emerges from discussions of the \u003Ca href=\"https:\u002F\u002Fbaselgovernance.org\u002Fnews\u002Ffirst-meeting-asset-recovery-knowledge-community-latin-america-explores-international\">Knowledge Community on Asset Recovery of Latin America\u003C\u002Fa>, an initiative of the Basel Institute’s International Centre for Asset Recovery. \n\nThe paper explores the retrospective nature of the law of *extinción de dominio*, which is a form of non-conviction based forfeiture mechanism present in some Latin American countries. It looks at the arguments on both sides for drafting laws that can be applied retroactively, i.e. to confiscate assets obtained or used illegally before the law came into force. \n\nIt introduces a fresh critical perspective to the debate, noting that extinción de dominio is a civil action with criminal content, rather than a criminal law per se. It is therefore not subject to the restrictions that commonly apply to criminal laws, including the principle of non-retroactivity. Its legitimacy as such is founded upon its application with full respect of fundamental rights. After only a handful of attempts to use it, a decision by the High Court effectively left it sprawled on the canvas.\n\nIn the last year or so, however, the mechanism has slowly started to prove itself. Most recently, the UK's Serious Fraud Office – in its first use of the UK's UWO mechanism – secured GBP 1.1 million from the sale of a property belonging to the ex-wife of a convicted fraudster.\n\nThis article offers a short history of UWOs in the UK. La consolidación de esta herramienta precisa de conocimientos especializados en la materia, así como la correcta interpretación de las categorías y presupuestos de la extinción de dominio, en armonía con los principios del Estado Constitucional de Derecho que la alberga.\n\nCon miras a la consecución de este objetivo, el Programa GFP Subnacional reconoce el importante rol de la doctrina jurídica como fuente mediata para aliviar los cuestionamientos que surgen en la aplicación de las leyes, y para orientar el conocimiento hacia la correcta adopción de decisiones.
