### English

This research paper covers the principles and practice of *Extinción de dominio*, Peru's non-conviction based forfeiture law. It is a publication of the Subnational Public Finance Management Programme of the Swiss State Secretariat for Economic Affairs (SECO) – Economic Cooperation and Development division and the Basel Institute on Governance. It offers a rigorous and up-to-date legal perspective on one of the most important instruments in the fight against organised crime and corruption.

Extinción de dominio, a non-conviction based forfeiture law regulated in Peru by Legislative Decree No. 1373, has become a key tool for the recovery of illicit assets. However, its implementation has generated debate about its compatibility with the principles of the constitutional rule of law. This publication seeks to contribute to this debate by addressing the legal basis for non-conviction based forfeiture and highlighting the importance of its application in accordance with democratic values and due process.

The volume brings together contributions from leading experts who analyse, from different angles, the main legal and interpretative challenges surrounding the extinción de dominio law. Topics covered include the rights at stake in the process, the time-limited application of the rule, the protection of third parties, autonomy vis-à-vis other judicial decisions, the burden of proof, res judicata, the principle of prevalence, and issues around publicity and confidentiality.

With this contribution, the Basel Institute and Subnational PFM Programme reaffirm our commitment to strengthening institutional capacities and promoting more effective and transparent justice.

Authors: Jeampool Johnnatan Giampier Gonzales Córdova, Sergio Enrique Rodríguez Salinas, Sergio Jiménez Niño, Erick Vladimir Guimaray Mori, Joseph Celso Domínguez Miñano, Jhanira Yamali Morales Aniceto, Walther Javier Delgado Tovar, Deily Arlene Pereda Rodríguez.",[21],[31],"2025-06-12","https://jam.baselgovernance.org/api/assets/0ca1c112-529a-450d-a12e-4204dbf266a1?width=600&height=840","Programa GFP Subnacional – Basel Institute on Governance",[],[192
https://www.gfpsubnacional.pe/publicacion/la-extincion-del-dominio-desde-sus-principios/","Acede a la publicación",[],[197
171,"Peru",[],[],[28],"2025-06-12T16:05:27.000Z","2026-05-29T22:22:59.000Z","/resources/publications/la-extincion-de-dominio-desde-sus-principios
2351,"progress-ukraines-anti-corruption-and-judicial-reform-efforts-update-ukraine-recovery","Progress in Ukraine’s anti-corruption and judicial reform efforts – update for the Ukraine Recovery Conference 2024",2638,2024,"This document takes stock of recent progress (July 2023 to June 2024) in strengthening Ukraine's anti-corruption ecosystem. The conference was hosted by Europol at its headquarters in The Hague, the Netherlands, together with the Basel Institute on Governance through the Joint Working Group on Criminal Finances and Cryptocurrencies.

The Recommendations are intended to highlight broad approaches and best practices. They are designed to help public and private actors stay one step ahead of those seeking to abuse crypto assets (also known as virtual assets) and services to make, hide and launder illicit money.

The main message is that as the use of crypto assets expands into practically every country and sector, so does its abuse to commit new forms of crime and launder criminal proceeds. Yet with the right tools, capacity and cooperation, the unique characteristics of blockchain-based technologies offer an unprecedented opportunity to investigate organised crime and money laundering networks and to recover stolen funds.

The five recommendation cover:

- Break down silos between “traditional” and “crypto”
- Regulate broadly and make full use of existing laws
- Take advantage of the blockchain to disrupt organised crime
- Raise crypto literacy through capacity building and clear communication
- Increase public-private cooperation
",[156,21],[31],"2022-12-07","https://jam.baselgovernance.org/api/assets/97e91bb6-6e69-4ff8-add6-c295cc0f9037?width=600&height=840",[425
/resources/news/cryptocurrencies-key-to-tackling-organised-crime-europol-and-basel-institute-on-governance-2279"," 2022 conference press release",[],[],[],[432
[435],2292,[156,28],[157],"2022-12-07T11:04:15.000Z","2026-06-02T14:09:03.000Z","/resources/publications/seizing-opportunity-5-recommendations-crypto-assets-related-crime-and-money-laundering",1780676585897]
