We need to find collective solutions and we need to address it collectively.”\n\n As a result of the recommendations and needs of law enforcement agencies and the positive feedback of participants who attended past ICAR workshops, the [ICAR training team](\u002Fnode\u002F225\u002F) conducted its 4th workshop on “Financial Investigations and Asset Recovery” in Thimphu, Bhutan during 13 – 17 November 2017. It included 34 participants from a total of 17 agencies\u002Fentities.\n\nThis workshop coincided with deliberations before the [Bhutanese National Council on the Anti-Money Laundering and Countering Financing of Terrorism Bill](https:\u002F\u002Fwww.rma.org.bt\u002Ffid\u002Facts;jsessionid=7C4A1583EFB4AC1D10CC3A2EAF91049C), 2017 (AML\u002FCFT Bill). The ICAR experts used this opportunity to discuss the proposed provisions in the Bill, which criminalise money laundering in line with international standards and provide wide-ranging freezing powers to the FIU. Bhutan ratified the United Nations Convention Against Corruption (UNCAC) in 2016, and is currently under review, thus emphasising the importance of a standalone AML\u002FCFT Bill, which can further strengthen the country’s hand in its fight against corruption and money laundering. This Bill seeks, amongst other aspects, to address the deficiency in the Anti-Corruption Act, 2011, which prevents a prosecution for self-laundering in contravention of UNCAC.\n\nThe training was geared towards creating a greater understanding of corruption, money laundering, Mutual Legal Assistance, asset tracing and recovery, financial investigative techniques, financial and electronic evidence, and challenges in investigating, prosecuting and adjudicating corruption in Bhutan. It aimed at equipping participants to handle complex issues of financial investigation and asset recovery in their respective roles as investigators, prosecutors or adjudicators, and drew attention to the role played by other relevant stakeholders such as financial institutions and insurance companies.\n\nAs a result of the excellent co-operation between the ACC and Basel Institute over the years, a Memorandum of Agreement was signed between the two parties on 24 May 2017. The agreement, among others, includes the provision of professional training, i.e. seminars and conferences, and exchanging experiences to detect and prevent corrupt acts. Both parties reconfirmed their mutual intention to continue to strengthen and promote their combined efforts to prevent and combat corruption in Bhutan.\n\nThe Basel Institute has been providing technical assistance to the Anti-Corruption Commission (ACC) of Bhutan in relation to its national anti-corruption endeavours for several years now. Already in 2011 it guided the ACC in the development and implementation of its 10-year institutional development plan, which included a complete restructuring of the agency with a view to better coordinating preventive and enforcement functions and strengthening the agency's independence. This initial work was followed up with support to the development of a national anti-corruption strategy, capacity building in financial investigation, and legal and policy advice relating to the use of legal intercepts. \n\nDuring these formative collaboration years, much of the Basel Institute's technical support to the ACC was made possible through financing from the Swiss Agency for Development and Cooperation (SDC) in the context of SDC's bilateral technical assistance program for Bhutan. The Basel Institute is looking forward to continuing its excellent collaboration with the ACC as experienced to date and remains convinced that Bhutan will continue making visible inroads in tackling corruption heads-on, both in terms of prevention and enforcement.\n\nThe official signing ceremony took place at the Basel Institute’s headquarters in Basel in the presence of Kinley Yangzom, ACC Chairperson and her accompanying delegation with Kinley Wangmo, Karma Thinlay and Kelden Jamtsho. Contracted by the Swiss Agency for Development and Co-operation (SDC) ICAR developed and delivered a 5-day training workshop entitled “_Financial Investigations and Asset Recovery_” which was held in Thimphu from 24 to 28 February 2015, and attended by a total of 28 participants, comprising representatives of the Judiciary, OAG, ACC, Royal Bhutan Police, Drug Regulatory Authority, Department of Revenue and Custom, and Bhutan National Legal Institute. In addition and for the first time, participants from various financial institutions, the Royal Insurance Corporation of Bhutan and Royal Audit Authority attended the training which increased the rich diversity of the interaction and communication.\n\nA Member of Parliament from the National Council also participated in the workshop to experience the training first-hand in the interests of ensuring that practical challenges and implementation issues raised by participants could be further addressed at a higher level where possible.\n\nThe customisation of the training to the Bhutanese legal environment and practice, incorporating local laws and names, once again proved to be a very successful approach. Many of the participants commented on the reality of the practical exercise, and applicability of the lectures to their legal system and experience.\n\nDuring the opening ceremony, the Honourable Chief Justice of Bhutan provided the keynote address, stating:\n\n“_After the conclusion of the first training, I have heard only praises from the judges and lawyers who attended the training last June. Some have banned cryptocurrencies, while others are embracing them to varying degrees. Some are working hard to align their anti-money laundering regulations with FATF standards, while others are turning a blind eye. A few countries have confiscated huge quantities of crypto assets linked to crime and money laundering. Others are at square one in terms of enforcement, risking becoming a hub for crypto crime and money laundering and posing a serious vulnerability in the world’s financial system.\n\nThis Working Paper draws on a detailed analysis of how selected countries are addressing legal, regulatory and enforcement issues around cryptocurrencies and other virtual assets. The analysis is focused on Asia, but set in the context of global trends in crypto law, regulation and enforcement.
